Texas generally requires the managing conservator’s written consent unless the managing conservator is the person seeking to adopt. A court may waive that requirement in certain circumstances. A child who is 12 or older must generally consent to the adoption in writing or in court, although the court may waive the child’s consent requirement when doing so would serve the child’s best interest.
